A. Procedure for Reporting Intellectual Property Infringement

It is Shopthegrece’s policy to:

  1. Remove or restrict access to content that, in good faith, we believe to infringe intellectual property rights after receiving a compliant notice.
  2. Terminate access to repeat infringers.

If you believe that any content on Shopthegrece infringes your copyright, trademark, or other intellectual property rights, please submit a Notice of Infringement containing the following details to our Designated Agent:

  1. Identification of the copyrighted work or intellectual property that you claim has been infringed, including applicable registration number(s), if available.
  2. Description of the allegedly infringing content, including:
    • How the content is infringing on your intellectual property.
    • The specific location (URL or webpage) where the content appears on Shopthegrece.
  3. Your contact information, including full name, mailing address, phone number, and email address.
  4. A statement under penalty of perjury confirming that:
    • You have a good faith belief that the disputed content is not authorized by the rights holder, its agent, or the law.
    • The information provided is accurate, and you are the rights holder or authorized to act on their behalf.
  5. Your electronic or physical signature.

B. What Happens After We Receive a DMCA Takedown Request?

Once a valid infringement notice is received, Shopthegrece will:

  1. Remove or disable access to the allegedly infringing content.
  2. Notify the member whose content has been removed or disabled.
  3. Enforce a policy against repeat infringers, which may include termination of access to our services.

C. Procedure for Filing a Counter-Notice

If you believe that content was removed by mistake or misidentification, you may submit a Counter-Notice to our Designated Agent with the following details:

  1. Identification of the content that was removed and where it was located before removal.
  2. A statement under penalty of perjury that you believe the content was removed in error or misidentified.
  3. Your contact details, including full name, mailing address, phone number, and email address.
  4. A statement consenting to the jurisdiction of the Federal Court in your location or where Shopthegrece is based in the USA.
  5. Your electronic or physical signature.

Once a Counter-Notice is received, we may:

  • Forward a copy to the original complaining party, informing them that the content may be restored within 10-14 business days, unless they file a legal action to prevent reinstatement.

Important Notice:
Under Section 512(f) of the DMCA, any person who knowingly misrepresents that content or activity is infringing may be liable for damages, including attorney’s fees.
