Intellectual Property Rights Policy
Shopthegrece is an e-commerce platform specializing in sneakers. We are committed to respecting intellectual property rights and strictly prohibit the sale of products that infringe on copyrights, trademarks, or related rights.If you believe that any content or product listed on Shopthegrece infringes your intellectual property rights, please follow the procedure below to submit a formal request for removal.
A. Procedure for Reporting Intellectual Property Infringement
It is Shopthegrece’s policy to:
- Block access to or remove any content (including text, graphics, and images) that we believe in good faith infringes on intellectual property rights after receiving a compliant notice.
- Remove and terminate service for repeat infringers.
If you believe content on Shopthegrece infringes your copyright or other intellectual property rights, please send a notice of infringement containing the following information to our Designated Agent:
- Identification of the copyrighted work or intellectual property that you claim has been infringed, including any applicable registration number(s).
- Identification of the infringing content, including:
- A description of how the material is being used in a way that constitutes infringement.
- The location of the infringing content on Shopthegrece (with sufficient detail for us to verify).
- Your contact details, including full name, mailing address, phone number, and email address.
- A statement confirming your good faith belief that the disputed use of the copyrighted work is not authorized by the rights holder, its agents, or the law.
- A statement made under penalty of perjury that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf.
- Your electronic or physical signature.
B. What Happens After We Receive a DMCA Takedown Request?
Once a valid infringement notice is received, Shopthegrece will:
- Remove or disable access to the allegedly infringing content.
- Notify the member whose content has been removed or disabled.
- Enforce a policy against repeat infringers, which may include termination of their access to our services.
C. Procedure for Submitting a Counter-Notice
If you believe your content was removed or disabled due to a mistake or misidentification, you may submit a counter-notice to our Designated Agent with the following information:
- Identification of the content that was removed or disabled, including where it appeared on Shopthegrece before removal.
- A statement under penalty of perjury that you believe the content was removed in error or misidentified.
- Your contact details, including full name, mailing address, phone number, and email address.
- A statement that you consent to the jurisdiction of the Federal Court in your location or where Shopthegrece is based in the USA and that you will accept service of process from the party who filed the original infringement notice.
- Your electronic or physical signature.
Once a counter-notice is received, Shopthegrece may send a copy to the original complaining party, informing them that the removed content may be restored in 10-14 business days, unless the rights owner files a court action to prevent it.
Important Notice
Under Section 512(f) of the DMCA, any person who knowingly misrepresents that content or activity is infringing may be subject to liability for damages, including attorney’s fees.
